TENANCY AGREEMENT

RESERVATION:

MINIMUM NIGHT STAY:
Please refer to our RATES page.

PAYMENT:
All charges are per night, plus 10.55% Estes Park vacation rental tax, plus $100 cleaning fee.  Half of the total price must be paid upon booking by a PayPal invoice sent by the office to the customer.  The second half of the payment is due (via the same PayPal invoice) 7 days before arrival. 

PAYMENT TYPE:
Credit cards are accepted (VISA-MasterCard-Discover).  Please notice that “Elements of Touch”, will appear on your credit card
statement.  If you pay by check, please make your check payable to: Estes River Retreat.

CHECK-IN/CHECK-OUT:
The check-in time is 3:00pm; early check-in may be arranged in some cases, but must be approved by management.  The check-out time is 11:00 am, but an extended check out (2PM) is available for $20 and must be requested prior to check-out day.
Tenants agree to such time periods so the property may be cleaned for the next guest.

SECURITY/CLEANING FEE DEPOSIT:
It is understood from both parties that any
damages to the property will be charged to your credit card. A written letter/ email  will notify you of the damages with a
replacement and inventory list. Should something break during your stay please notify us before you leave.

FINAL CLEANING:
At the end of the rental term the tenant shall leave the premises clean and in good condition. Final cleaning payment is $110.

OTHER:
There will be no daily housekeeping.  Fresh linens and towels are provided.  Refer to our AMENITIES page for more information.

CANCELLATION:
If you cancel your confirmed reservation and the unit is not re-rented for the cancelled period of 45 days  you will forfeit your
advance rent payment.  If you had to reserve and pay in full  the 50% down will be forfeited and the rest returned to you.

If the unit is re-rented for all dates previously booked by you, all money prepaid will be 100% refunded.  However, there will be $50 .00 processing fee . Refunds will be returned with in 30 days by check mailed to your address.

UTILITIES:
All “normal” utilities are included.

PETS:
There shall be no pets allowed on the premises unless they are working dogs   However, within a 2 minute walk there is a Animal
Hospital where pet boarding is available.  They are very reliable and can be reached at 970-586-4703.  Refer to our
AMENITIES
page for more information.
However during  the
off season some well behaved pets are allowed with special permission $7.00 daily.

NO SMOKING POLICY:
No smoking is allowed inside the house whatsoever.   A $50 fine will be placed if there is evidence of smoking.

GUESTS/PARTIES/NOISE:
The Tenant must supervise Guest(s) while on the premises.  Tenant and their guests agree not to violate the quiet enjoyment of
the surrounding neighbors and to respect their privacy and property.  Tenant is aware that a small private massage clinic is
located on property grounds and will be in operation during normal business hours 9-5 Mon -Fri.  Tenant agrees to obey all laws
and ordinances.  Maximum occupancy of 6 must not be exceeded.

RIVER FRONT LIABILITY:
All occupants understand the possible danger a river posses and possibly very high water levels in the spring.  Owners are in no
way responsible for any incident or accident resulting from any interactions with the river.  It is HIGHLY advised to keep young
children ( under 15 years old) away from the rivers edge and always supervised.

TENANT RESPONSIBILITIES:
All occupants are required to handle the home and contents with due care, and to perform “Normal” household duties that
include: cleaning of dishes, garbage removal, recycling, notification to owner of any damages or problems with the property,
locking of all windows and doors when leaving the house.

OFF HOURS ARRIVAL:
We have a lock box outside the front door.  With your confirmation letter you will receive the security code.

BREACH OF AGREEMENT:
Failure to comply with any of the foregoing clauses will subject you to immediate removal and forfeiture of all rental payments.

CONFIRMATION POLICY/AGREEMENT FORM:
We  e-mail you your reservations with all the information you will need including your security code to enter the property.
